Why every construction employer needs this form
South African labour law is unforgiving about paperwork. The Basic Conditions of Employment Act requires you to give every employee written particulars of employment, and when a dispute lands at the CCMA, the employer without a signed contract starts the hearing already losing. In construction — with mixed permanent, fixed-term and casual crews — this bites harder than in most industries.
The BuildCape employment contract covers the essentials a small construction business needs: parties and job description, remuneration and payment cycle, working hours and overtime, leave, notice periods, and site-specific conduct terms. The library also includes a Fixed-term Contract (for project-duration hires — with the fixed term properly motivated, which matters legally) and a Casual Labour Contract for short engagements.
Getting it right
- Sign before the first shift, not after — a contract signed mid-dispute is worth little.
- Fixed-term contracts should state the project or period and the reason for the fixed term.
- Keep a signed copy in the employee's file with their ID copy and UI-19 details.
- Pair it with the UI-19 UIF declaration — UIF registration is compulsory, even for casual workers meeting the threshold.

Is a verbal employment agreement valid in South Africa?
A verbal agreement can create an employment relationship, but the BCEA still requires written particulars of employment — and without a signed document you have almost no evidence of the agreed terms at the CCMA. Always get it in writing before work starts.
What's the difference between fixed-term and casual contracts?
A fixed-term contract runs for a stated period or project and should record the reason for the fixed term. Casual arrangements suit genuinely irregular, short engagements. Using the wrong one — especially rolling casuals doing permanent work — creates legal risk; the library includes both so you can use the right one.
Do I need a lawyer to use this template?
For standard hires the template covers the essentials. For senior appointments, restraints of trade, or anything unusual, have an attorney review the final document — the template gives them a solid, cheap starting point rather than billable hours from scratch.
